MPCHECK Ltd. (MPCHECK) respects the privacy of the users of the websites and/or applications operated and/or managed by MPCHECK and/or by anyone on its behalf (jointly MPCHECK), including all or some of the parts, areas or sections of the websites and/or applications, and/or other dedicated applications (jointly and severally the Website). Accordingly, MPCHECK will not make any use of the Information (as defined below), except in accordance with this Privacy Policy. By using the Website, you also agree with the contents of this Privacy Policy (as it will be updated from time to time).

The purpose of this Privacy Policy is to clarify and explain the privacy policy in relation to the users’ use of the Website and acceptance of the services offered by MPCHECK (the Services), including the manner in which we collect and use the information provided to us and/or collected by us as part of the use and/or browsing of the Website and/or receipt of services from MPCHECK. This Privacy Policy applies to all users of the Website using a computer and/or any other device (mobile phone, tablet, etc.), or to any of our services, and to all information provided to us.

Please read this appendix to this Privacy Policy before using the Website and receiving any services from us, and before transferring personal data (such as name, email address, health information, etc.) to us. This document is an integral part of the Terms of Use of the Website (www.mpcheckhealth.com) and they must be read together.

You are aware and agree that we may, from time to time and at our sole discretion, modify the provisions of this Privacy Policy and/or any other document that replaces it. The updated version of the Privacy Policy will be published at any time at www.mpcheckhealth.com.

Everything contained in this Privacy Policy applies to both women and men alike.  Furthermore, whenever the singular is used, it should be read as if it refers to the plural as well, and vice versa, as the case may be.

The headings in this Privacy Policy are for convenience only and should not be used for interpretation.

Information Collection

MPCHECK may collect and save information about the visitors and users of the Website and about the recipients of our services, that is transferred by you or collected by MPCHECK as a result of and/or in connection with the use of the Website (above and below, the Information).

There are two types of Information as detailed below, which includes any analysis and/or processing of the Information:

Active Information – Information: (a) That will be provided to MPCHECK by you for various purposes (registering to the Website, completing the test suitability questionnaire, contacting the Customer Service Center, or for any other need); and (b) Information collected by MPCHECK from other sources, including the results of the medical tests that will be carried out for you and/or the analysis of the tests results. Said Information may include, inter alia, name, address, social security number, email, telephone number, profile picture, as well as details about your medical condition, your personal preferences and habits, your physical characteristics, your hereditary background, etc., required for that purpose of providing the service. It is noted that you are not obligated in any way to provide any details to MPCHECK; however, it is possible that failure to provide such details will restrict your ability to view and/or use of the Website and/or receive the services from MPCHECK.

If you provide Information about other people to MPCHECK (for example, a family member), you must notify MPCHECK to this effect prior to providing the details about that person. Furthermore, before you provide MPCHECK with Information about other people, you must inform them of the contents of this Privacy Policy and obtain their consent in advance, so that Information about them can be used in accordance with the provisions of this Privacy Policy.

Passive Information – Information that is collected without having been actively provided by you or by a third party (such as the type of browser you use to navigate on the Website, information about the computer or other device that you use to access the Website, your IP address, your preferences and websites content, and more). In this regard, it is noted that the Website may include and/or use software and/or identification and/or tracking technologies of various types, such as applications that collect information (cookies). These software and applications enable to collect Information about you (including information about your personal preferences), inter alia, for the proper operation of the Website, to adapt the Website to your personal preferences, improve the service to users, improve MPCHECK’s products, verify details provided through the Website, information security, etc. Sometimes, the activation of such software and applications is conditional on your approval; however, it is noted that such approval is not always requested.

MPCHECK will be entitled to collect and save any Information (both Active and Passive) in any manner and in any way, and for any period of time we choose, at our sole discretion. Furthermore, you agree that MPCHECK can include the Information in one or more of the registered databases in our possession and/or owned by us, and/or managed by us.

MPCHECK keeps the Information for as long as it is needed it for the purpose of accomplishing the objectives permitted to us according to this Privacy Policy, or for a longer period in accordance with the statute of limitations established by applicable law, or in accordance with the instructions of a relevant regulatory authority. To ensure that personal information about you is not kept beyond the minimum period of time necessary to achieve the objectives described above, MPCHECK conducts periodic evaluations and removes excess Information that is no longer needed from our systems and records, or anonymizes it so that it will no longer be possible to identify you through it.

Use of the Information

MPCHECK is entitled to use the Information only according to this Privacy Policy or according to the provisions of any law, including for the purposes listed below:

  • Customer service, to answer your questions and be in touch with you.
  • To adapt your Website experience to your interests, to display to you content that we think may be of interest to you, and to show you the content according to your preferences.
  • To provide administrative information related to the use of the Website (for example, to perform, complete, or confirm a transaction).
  • To simplify your connection to the Website by creating forms that will include Information that allows to automatically identify you personally, without you having to complete the information yourself.
  • For MPCHECK’s internal business purposes, such as targeted advertising, data analysis, reviews, fraud prevention, and others.
  • To analyze data you provided and/or MPCHECK received from third parties (such as the results of the medical tests you performed as part of the services we provide), and provide information and/or suggestions in connection with the results of such data analyses.
  • To send to you, via mail, email, text messages or via any other direct means of communication (including via short messages, automatic dialers, direct mail, etc.), informative news about MPCHECK and about the services offered by MPCHECK, as well as newsletters, messages tailored to your preferences, information regarding products or services you have purchased (to the extent that you purchased them), or about other products and/or services that may, in our opinion, be of interest to you, including promotional materials from our partners and marketing content.

In fact, by using the Website and/or receiving services from MPCHECK, you agree to receive Information that we will send you as stated in Section F. At the same time, you will be entitled, at any time, to cancel your consent to receive advertising material by contacting our Customer Service in writing at info@mpcheckc.co.il, or by clicking the link www.mpcheclc.co.il at the bottom of any marketing email you receive from us. Any such request for cancellation will become effective no later than seven business days from the date it is received by MPCHECK. For the removal of any doubt, it is noted that refusing your consent to receive such advertising material does not detract from MPCHECK’s right to use the Information for the purposes listed in Sections A through E above.

Transfer of Information to Third Parties

MPCHECK will ensure that the Information that will be kept by MPCHECK will be subject to the provisions of the Privacy Protection Law, 1981 and its regulations, and the provisions of any other law. The aforementioned Information will be stored in MPCHECK’s databases and will not be transferred to third parties without your consent, except for entities that act as MPCHECK’s suppliers and/or work in cooperation with MPCHECK, and that provide us with various services that include access and/or processing of personal information that we are allowed to carry out on our own, such as generating invoices, debt collection, information processing, marketing, advertising, customer service, digital services and e-commerce, courier and postal services, IT information technology services, clearing services, surveyors and marketing consultants, etc., including the performance of the medical tests required to provide the services. For the removal of any doubt, MPCHECK’s engagement with contractors or external service providers as mentioned above does not detract from our responsibility according to any law regarding the manner in which Information about you is used.

Notwithstanding the above, MPCHECK will be entitled to transfer Information, including personal information, to third parties without obtaining your consent in the following cases: (a) When transfer of the Information is necessary to prevent damage to you or third parties; (b) When transfer of the Information is required by law and/or judicial order; (c) If you violate the Terms of Use of the Website or performed or attempted to perform actions prohibited by law; (d) When disclosure is required for legal proceedings in which MPCHECK are involved; or (e) In the event of a merger and/or MPCHECK structural change, or the merger of our activity with the activity of a third party, and/or in connection with any transfer of the Website’s businesses.

Reviewing the Information

You have the right to contact MPCHECK at any time for the purpose of reviewing the Information that relates to you and is stored in our databases. Furthermore, you are entitled, in accordance with and subject to the provisions of any law, to request a change and/or correction of the Information about you and/or to delete the Information. It is noted that, notwithstanding the above, MPCHECK will be entitled in any case to keep in our databases Information that is collected by MPCHECK independently and/or that is not used by MPCHECK for the purpose of contacting you (such as Information we need or helps us in our business operations), and all in accordance with and subject to the provisions of the law.

Information Security

We implement information security systems and procedures on the Website and take reasonable precautions in accordance with the standards used in the Internet industry, including physical and electronic security measures, including with the holders of the Information on MPCHECK’s behalf. The Website and the information in it are well secured, and you can feel safe when accessing it. Notwithstanding, it is note that MPCHECK cannot guarantee that the Information and everything contained in the Website and in the services provided by MPCHECK are immune against unauthorized access to them and, as a result, MPCHECK cannot guarantee that unauthorized third parties will not gain access to the Information. Therefore, MPCHECK will not be held responsible for any damage you may suffer, if any, as a result of disclosure of the Information, alteration or improper use of the Information during Information transfers.

MPCHECK stores the Information within the borders of the State of Israel and in other countries, in accordance with the privacy protection laws applicable in Israel. The law of the country where the Information is stored and processed may also apply to the Information. When registering for the Website, you must enter a password that will identify you each time you log into the service (the Identification Means). Also, MPCHECK will be able to add to the Identification Means other means of identification that will be required for the purpose of using the Website. It is noted that you will be solely responsible for keeping your Website’s Identification Means confidential, by limiting access to the computer or mobile device from which you access the Website and by properly logging out of your user account when you finish using the site. You will be solely responsible for any act or omission while using your Identification Means. Moreover, you undertake to notify MPCHECK immediately of any illegal use of your Information or Identification Means, to the email address indicated in this Privacy Policy.

Conduct of Third Parties

Ads that appear and/or will appear on the Website are provided by our advertising partners, who are entitled to identify or save a unique cookie in your computer, which will collect information that does not allow identifying you, including information about how you use the Website, for example, the number of ad views, and they may use this information to show you advertisements.

Moreover, the Website may include links to websites and/or applications of third parties, which are not managed and/or owned by MPCHECK. MPCHECK provides these links for convenience purposes only, and their appearance on the Website should not be considered a promotion of these third-party sites or a solicitation to use them. Transactions carried out through the aforementioned websites (and personal information provided to them) will be completed on the aforementioned websites and not on the Website, and will be subject to the privacy policies of the aforementioned websites.

Use of the Website by Children

MPCHECK considers protecting the privacy of minors (under the age of 18) very important, and we do not knowingly collect or use their personal information on the Website. Minors using the website are obliged to inform MPCHECK in advance that they are minors and present a power of attorney from a parent/or guardian before providing Information on their behalf. In any event, if any person becomes aware a minor relative of theirs provided Information through the Website, they are requested to contact MPCHECK for the purpose of deleting this Information.

Applicable Law and Jurisdiction

The law applicable to and in connection with this Privacy Policy and the use of the Website is the law of the State of Israeli only (regardless of whether the Website is used in Israel or abroad).

The exclusive jurisdiction in connection with this Privacy Policy and the use of the Website is of the competent court in Tel Aviv-Yafo only.
